Why You Need a Trust-based Estate Plan

Who will care for your children if something happens to you?

If you don’t choose a guardian, the court will.
A legally valid will allows you to name the person you trust most to care for your children if the unthinkable happens. Without one, a judge decides who raises them—and it may not be who you’d choose.

How can I protect my children's inheritance?

Without a trust, they receive everything at 18.
A trust lets you control when and how your children receive their inheritance, based on their maturity. It also shields their assets from creditors and keeps the court from deciding how the money is managed.
Who handles my finances if I’m incapacitated?
It’s your choice—or the court’s.
By setting up a Durable Power of Attorney, you pick someone you trust to manage your finances if you can’t. Without it, a judge may appoint someone who doesn’t understand your wishes—or your family.
Won’t everything just go to my spouse if I die without a will?
Not always—and not automatically.
In many cases, assets in your name alone may have to go through probate, even if you're married. Without a will or trust, the court decides how those assets are divided—which can delay things, cost money, and cause stress for your family. Estate planning ensures your spouse and children are taken care of, without uncertainty.
What’s the difference between a will and a trust?
Both protect your family—just in different ways.
A will outlines your wishes after death, including who receives your assets and who cares for your children. But it must go through probate, which can be slow and costly. A trust avoids probate altogether—offering more privacy, faster access to assets, and control over when and how your loved ones receive their inheritance.

A trust-based estate plan protects your family by ensuring your wishes are carried out if something happens to you. It lets you:
